I am currently in the early stages of working on a new project with some colleagues of mine. We wish to launch our very own music download site. We understand that this will require a custom design for it to stand out from the crowd; and a comprehensive shopping cart system, along with content managment system. Which is why we have decided to outsource this to a reputable webdesign and hosting service iwebsoloutions based in London. Please keep in mind that we understand that this isn't going to happen over night, or in a few months for that matter. We are committed to the project and have realistic expectations of launching in the spring of 2010. The advice we require is more legal than design and technical. Our main ambition is to sign a deal with one of the big music companies such as sonybmgmusic as we7 have just done. But until we're established this isn't going to happen. We want to know what kind of licenses are required for such a project, and where to aquire them. Also how the royalties system would work, is this integrated within the licencing fee, or is it calculated by sales. Any other legal issues you may have advice on regarding this matter would be grately appreciated.

You project sounds fascinating, good luck with it. One thing is not clear to me, you said:

You seem to suggest you have already signed an agreement with SonyBMG Music, they you said "until we are established this will not happen" which is which?
Have you or have you not signed distribution agreement with SonyBMG?

Good luck with this but bear in mind that iTunes is now cheaper, DRM free, and even with their power it took months and many failed other attempts on the record industry's behalf (eg launching a rival service via Amazon) for iTunes to get what they wanted....
